While The Rest of America Watched Obama…
The United States Supreme Court was hearing arguments in D.C. vs. Heller.
If you’re unfamiliar with the case, it is pretty much going to decide the legality of a complete ban on all handguns at any level of government, which is what the District of Columbia had instituted for many years.
With the Roberts Court being a nearly perfect ideological split (4 conservatives, 4 liberals, 1 barely-right leaning moderate), it has been interesting to watch the line of questioning from the justices. For those of us who believe the handgun ban is unconstitutional and violates the 2nd Amendment, things are looking good.
From following the SCOTUSblog’s transcripts, the line of questioning that has come from Justices Roberts, Thomas, Scalia, Alito, Kennedy, and Souter all seem to indicate that they will rule that the gun ban is unconstitutional. That would be 6 votes right there, and would be a victory for gun ownership rights.
What is interesting is that I’m almost convinced that nearly all of the Supreme Court Justices could very well vote along these lines. Can you imagine a 9-0 vote to strike down the D.C. gun ban? That would be a massive blow to anti-gun activists.
Any way you slice it, this is shaping up to be a landmark moment in the ever-persistent battle between those who support gun ownership rights and those who want much stricter gun control.
